FEDERAL LAW EFFECTIVE JULY 1, 2003

On July 1, 2003, the Environmental Protection Agency (EPA) issued a new Construction General Permit that controls all construction projects that have the potential to pollute any waters of the United States. Stringent requirements have been implemented that include:
As of March 10, 2003, all projects of 1-5 acres (or smaller if they are part of a larger plan of development or sale) must comply with the NPDES or the AZPDES (for Arizona projects);
From July 1, 2003 forward, all projects subject to NPDES or AZPDES requirements must have a SWPPP in place at least seven days prior to any construction activity; and
All projects must have a "Qualified Person" to inspect the project for compliance with and modification of the SWPPP.
Those who do not comply with the Federal law can be subjected to fines exceeding $32,500.00 per day, per violation ($25,000 per day, per violation in Arizona).
